    Export Regulations: Export of night vision equipment and optical sighting equipment is controlled by the U.S. Department of State Office of Defense Trade Controls, in accordance with International Traffic in Arms (ITAR), Title 22, Code of Federal Regulations Part 120-130 and/or the Export Administration Regulations (EAR) U.S. Department of Commerce.


    It is unlawful to export, or attempt to export or otherwise transfer or sell any hardware or technical data or furnish any service to any foreign person, whether abroad or in the United States, for which a license or written approval of the U.S. Government is required, without first obtaining the required license or written approval from the Department of the U.S. Government having jurisdiction.
    It is the Resellers/End Users responsibility to request and obtain export licenses for the export of the subject items, and to ensure that the requirements of all applicable laws, regulations and administrative policies are met.


    Sales or transfers to entities on the List of Debarred Parties, Denied Persons list and Embargoed Countries are strictly prohibited.

    Export of GEN-3 and Thermal night vision equipment from the United States without a valid export permit issued by the U.S. Department of State, Office of Defense Trade Controls is strictly prohibited. Diversion contrary to U.S. law is prohibited.

     

    All notices from NVGSTORE.COM to You may be posted on our Web site and will be deemed delivered within thirty (30) days after posting. Notices from You to NVGSTORE.COM shall be made either by e-mail, sent to the address we provide on our Web site, or first class mail to our address at:

  • Return Policy

  • CANCELLATION:  For Seller’s standard products, if buyer requests a total or partial 

    cancellation of undelivered products under this order, Seller may assess, and Buyer agrees to 

    pay, cancellation charges of 20% (expressed as a percentage of the price of undelivered 

    products): 

    In lieu of cancellation charges, Buyer may place an order for other Seller product(s) in an 

    amount equal to 110% of the price of such cancelled deliveries in accordance with this 

    provision.  In such case, Seller may assess re-stocking fees not to exceed 30% of the price of 

    undelivered products.  Non-standard product may not be considered for cancellation. 

     

    RETURN FOR CREDIT:  For Seller’s standard products, if buyer requests a return for credit, 

    Seller will assess, and Buyer agrees to pay, a restocking fee of 15%.  

     

    SPECIAL TERMINATION PROVISION: The parties agree that the Buyer’s obligation to make 

    timely payment of Seller’s invoice is a material requirement of this contract.  Notwithstanding 

    any other term or condition of this contract, failure of the Buyer to make any payment to the 

    Seller within 30 days of its due date shall constitute a material breach of the contract entitling 

    the Seller to terminate the contract for default without further notice to the Buyer and to recover 

    all its damages including consequential and incidental damages and lost profits. 

     

    Failure of the Seller to terminate the contract for default or delay in terminating this contract for 

    default hereunder for any one or more late payments shall not constitute waiver of the right to 

    terminate this contract for default with respect to any current or future late overdue payments. 

    NVGSTORE.COM reserves the right to change its payment procedures at any time without prior notice to you.
